NudgePal is operated by Ana Isabel Rodriguez Morelos, a sole proprietor based in Makati City, Metro Manila, Philippines. NudgePal at https://nudgepal.app is a one-to-one follow-up and review-request tool. These terms are the agreement between you and Ana Isabel Rodriguez Morelos (“we”).

The product

You add a customer. We show you when a quote follow-up or a review request is due, and we fill in a message you can edit. You send that message yourself, to that one customer, from your own phone, using WhatsApp, SMS, or email. We do not send it for you, and we do not receive the reply.

Accounts

You need an email address. Keep your password to yourself. You are responsible for the customer details you enter and for having a lawful reason to contact those people.

Plans and payment

The free plan includes up to 10 active customers (quotes in progress, finished jobs waiting on a review, and jobs you marked won). Pro is $6/month in US dollars for an unlimited list. Taxes may apply. You can cancel anytime and keep Pro until the end of the period you already paid for.

Our order process is conducted by our online reseller Creem, who is the Merchant of Record for all our orders. Creem handles payment, billing, tax and invoicing and provides all customer service inquiries related to payments and returns.

Your messages

You are the sender. Each message goes to one customer you already have a relationship with. You decide whether local rules allow that message. Do not contact someone who has asked you to stop, and do not pretend the message was sent by someone else.

Reviews

Ask every finished customer for a review, and invite them to reply to you if something was wrong. Do not pay for a review. Do not send the public review link only to happy customers. The US Federal Trade Commission has said that steering only positive reviewers to a public site can be a deceptive practice.

Acceptable use

• Don’t break into, scrape, or overload the service.
• Don’t upload data you have no right to store.
• Don’t use the list to contact people who have told you to stop.

Availability

The app is provided as available. We may change features, the free limit, or the price for new billing periods. We will say so on the site before a price change applies to a renewal.

Liability

NudgePal helps you remember who to contact. It does not promise that a customer will reply, hire you, or leave a review. To the fullest extent the law allows, we are not liable for messages you send, jobs you win or lose, or reviews that are or are not posted. Our total liability arising out of the service, whether in contract, tort, or otherwise, is capped at the fees you paid for NudgePal in the 12 months before the claim. If you paid nothing in that period, our liability is zero. Nothing in these terms limits liability that cannot be limited under Philippine law, including liability for fraud or for death or personal injury caused by negligence.

Law

These terms are governed by the laws of the Philippines. The courts of Makati City have exclusive jurisdiction, except where a consumer law that applies to you says you may sue somewhere else.
